Karnataka Act No.38 of 2026 changes coverage, registration and employment obligations.

The new section 3(1)(k) excludes establishments employing ten or more workers if already registered under the OSH&WC Code. Applicability must therefore be resolved before using the state Act’s leave and hours provisions.

Registration continues until closure or cessation. New provisions require a service certificate within seven days of an employee’s application and prohibit retention of original employee documents. Read the full amendment for the other changes.

A conditional working-hours exemption applies to commercial establishments other than shops.

Read details & sources

The order dated 5 July 2025 permits up to ten hours per day, subject to a 48-hour week. Work exceeding 48 hours a week attracts overtime, within the order’s quarterly limit.

This is not a blanket ten-hour rule for shops. Read the scope and every condition in the order. A breach can lead to revocation.

Online self-certification provides a conditional exemption from opening/closing hours and the establishment close-day provisions.

The exemption under sections 9 and 10 requires registration on the departmental website. Employee working-time conditions still apply.

Night work for women requires the separate exemption and its safeguards. Display the notification at employee entrances and exits, and read its conditions in full.
